Provitron Hosting Policy In order to use Provitron Hosting's services, you must agree to the following Provitron Hosting policies. The bulleted list of items below is the summary of, but not all of our policies. The limit of liability to Provitron in the event of service failure is to your current monthly bill ONLY. Although we do perform weekly backups of data, Provitron Hosting is not responsible for lost data. It is your responsibility to make a backup of all data before using our servers. Do not use Provitron's servers to send SPAM. Doing so will result in termination of your account, a $500 cleanup fee, and a $5 fine per SPAM e-mail. Do not abuse our UnLimited Bandwidth offer. Using more than 70% of our monthly servers bandwidth may result in account termination. We reserve the right to change our prices at any time. Failure to pay in a timely mannor may result in account termination. Release Of Liability Use of Provitron's services is at the customer's sole risk. Neither Provitron Systems Corp. , third party services, its employees, affiliates, alliances, merchant licensors or the like, warrant that Provitron's services will not be interrupted or free of error. In no circumstance will Provitron, its employees, partners, or its affiliates be liable for any claims, any action either direct, indirect, special, incidental, or consequential, or any damages either punitive or alleged to have resulted, including loss of profits, from the use of or inability to use Provitron's services, from service interruptions, from customer errors or problems with their Internet connectivity, from unauthorized access to Provitron's servers, from communication failure, from bandwidth congestion, interruptions, or from any other reasons resulting in inability for Provitron to provide services including acts of God. Backups Of Data Provitron Systems Corp. Uses RAID 1 or RAID 5 on all servers. The use of this technology allows for instantaneous backup of all data. While this protects you, the customer, against hard drive failure on our servers, quality of or availability of backups is not guaranteed. It is the customers responsibility to have a backup of all data. In the event of a loss of data Provitron will make every effort to retrieve data from any current sources. In addition to our instantaneous backup systems, Provitron does weekly data backups to disk. We do weekly backups as oppose to daily backups as most instances of data loss occur when the customer inadvertently deletes data. This allows the customer time to request a backup which may still contain data. Email, Email Servers and SPAM Email may only be sent to those who have explicitly requested it and must use accurate header information and valid return E-mail addresses. All requests by email recipients to no longer be sent email must be followed. If a website hosted by Provitron or an email address is referenced in spam originating from Provitron's servers, the responsible user will be responsible for a minimum $500 clean up fee to a maximum fee of $5 per sent email. The distribution or use of mass emailing programs is strictly prohibited without authorization. A maximum of 10,000 emails per week may be sent as bulk; greater quantities require an account upgrade to a business plan. Provitron employs RBL, RSS and DUL, SURBL and other services to remove SPAM. Posting obscene, outrageous, or inflammatory messages or email in order to solicit numerous responses, subscribing yourself in mass or other Internet users to listservs or mailing lists, threatening other Internet users, mail bombing Internet users and running packet sniffers or port scanners will result in immediate account termination and possible legal action. Provitron will terminate any account that engages in abuse of our systems, and/or other customer's sites. This abuse includes, but is not limited to: Excessive use of CPU and/or storage resources, attempting to gain access to customer accounts or disrupting our systems in any way. Should a violation of this user policy occur, you will be held responsible for any damages to Provitron, Provitron's business, services, equipment, network, operations, or reputation resulting from your actions including, but not limited to, government actions, vandalism, retaliation, and claims of libel, unfair competition, infringement of patent, copyright, trademark, service mark, or other intellectual property right, violation of privacy, or other tort. Provitron shall be the sole arbiter as to what constitutes a violation of any of these provisions. UnLimited Bandwidth Provitron does not set explicit limits to bandwidth on any account; however, we do employ soft limits. Any website which consistently uses over 70% of any servers bandwidth may be first warned. Account termination may occur if Provitron's unlimited bandwidth policy is abused. Pricing and Payment Provitron reserves the right to change its prices at any time. All pricing is guaranteed for terms of special pricing. Payments are due on the 7th day of each month. Failure to pay or late payments may result in account suspension or termination. Provitron bills for services prior to services being rendered. Late Payments will be charged a $5 late payment fee. Returned checks or failure of payment method to be accepted by the bank will result in a $25 processing fee. Provitron accepts the following methods of payment: Visa, MasterCard, American Express, Electronic checks, and Paper checks. Reseller Accounts Reseller accounts are the property of either the reseller or the reseller's client. These accounts may be moved from Provitron's servers at any time at the sole expense of the reseller and/or the reseller's clients. Reseller clients wishing to stay with Provitron may continue to do so with Provitron taking over ownership of the account. If a reseller violates any of Provitron's policy, Provitron may assume ownership of the Reseller's accounts. Policy Modification Provitron reserves the right to modify our policies at any time and in any way. Modifications to our policy will be posted to www.provitron.com and emailed to all client and reseller email accounts.
